By booking with us,  you agree and accept the Terms and Conditions set out on booking Confirmation. You acknowledge that you are 18 (eighteen) years of age or older and that you understand and have the legal capacity to agree to the booking terms.

Indemnity

We respect your right to privacy and therefore aim to ensure that we comply with the legal requirement of the POPI Act which regulates the manner in which we collect, process, store, share and destroy any personal information which you have provided to us. 

 

What is personal Information?

The Act defines personal information as information relating to an identifiable, living, natural person, and where it is applicable an identifiable existing juristic person.

Information relating to race, gender, sex, pregnancy, marital status, national, ethnic or social origin, colour, sexual orientation, age physical or mental health, well-being,

disability, religion, conscience belief, culture, language and birth of the person. Information relating to the education of the medical, financial, criminal or employment history of the person, any identifying number, symbol, e-mail address, physical address, telephone number, location information, online identifier or other particular assignment to the person, the biometric information of the person, the personal opinions, views or preferences of the person, correspondence sent by the person that is implicitly or explicitly of a private and confidential nature or further correspondence that would reveal the contents of the original correspondence, the views or opinions of another individual about the person and the name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person.

Why we collect Personal Information: 

We collect personal information in order to liaise with you telephonically, via our website, via email, and/or any other means of communication. The information we may collect, amongst others include personal details such as your name, email address, telephone address, residential or business address, billing information such as payment information and VAT registration number and legally required information, which includes any additional information that the law requires from us to verify your identity. 

 

We collect your information so that we may: 

1. Respond to any query or comment received from you; 

2. Inform you of new offers; 

3. Enable us to process, validate and verify information and requests for the supply of goods and/or services;

4. For the purposes for which you specifically provided the information; and 

5. Generally to improve your experience on our website. 

 

Processing of Information:

We will share your personal information: 

1. In order to comply with applicable law or with legal processes served on our company;

  1. In order to protect and defend the rights or property of our company; 

  2. We will only share your personal information for purposes of providing services to you or any other legitimate business purpose relating to our business activities, including but not limited to, the protection of our or your rights, complaints, marketing, or enforcing any agreement between us.

  3. In certain circumstances, we may share your personal information with our service providers. We only share information with service providers after we enter into an agreement with the service provider to regulate the way in which the personal information will be secured.

  4. Where the law requires us to do so, we may also share your personal information with third party service providers, agents, contractors, employees, law enforcement agencies or business affiliates. We will only share your personal information in these instances where it is necessary for us to do so and only to the extent that your personal information is needed for such third parties to perform their services or obligations.

 

Security Measures:

We will:

1. Treat your personal information as strictly confidential; 

2. Take appropriate technical and organisational measures to ensure that your personal information is kept secure and is protected against unauthorised or unlawful processing, accidental loss, destruction or damage, alteration, disclosure or access; 

3. Promptly notify you if we become aware of any unauthorised use, disclosure or processing of your personal information; 

4. Provide you with reasonable evidence of our compliance with our obligations under this policy on reasonable request; and 

5. We will not retain your personal information longer than the period for which it was originally required, unless we are required by law to do so, or you consent to us retaining such information for a longer period.

ALTHOUGH WE TAKE THE AFOREMENTIONED PRECAUTIONS IN PROTECTING YOUR PERSONAL INFORMATION, WE SHALL HOWEVER NOT BE LIABLE FOR ANY LOSS OR DAMAGE, HOWSOEVER ARISING, SUFFERED AS A RESULT OF THE DISCLOSURE OF SUCH INFORMATION IF OUTSIDE OUR REASONABLE CONTROL. 

 

Your rights: 

You have the right at any time to: 

1. Rectify the Personal Information collected by us; 

2. Object to the processing of Personal Information (subject to legislation); 

3. Request the return or destruction of Personal Information (subject to legislation); 

4. Lodge a complaint with the company. 

 

The Personal Information processed by us is not routed/transferred to a third country or International organisation.

GENERAL
 

1. All lagoon cruises and eco tours require a minimum of 10 adult passengers to enable a departure.
2. All guests are required to arrive at least 30 minutes prior to departure to check in and collect boarding passes. Featherbed Co. reserves the right to depart all vessels as scheduled.
3. Featherbed Co reserves the right to cancel any cruise or tour due to unforeseen circumstances, including but not limited to, extreme weather conditions.
4. All cruises and tours will commence with a safety briefing as required by the South African Maritime Law. No persons are permitted to jump overboard and/or swim.
5. All vessels, with the exception of Threelegs, are licensed floating restaurants with full cash bar facilities therefore no food or beverages may be taken on board any of our vessels.
6. Featherbed Co reserves the right to not admit or serve any passengers who appear to be under the influence of alcohol or any banned substances.
7. No alcohol will be sold to children under the age of 18 years.
8. Featherbed Co reserves the right to amend the current terms and conditions without notice.

 

PAYMENTS & CANCELLATIONS


1. Please note that a reservation is not confirmed or secured until the payment requirements have been met. The Featherbed Company reserves the right, without notice to the Company/guest/group/independent traveller (hereinafter referred to as “the guest”), to release any bookings held where the required pre-payment has not been made within the stated period.
2. Full payment is required upon making an online reservation and proof of payment will be required in order to receive confirmation.
3. No refunds will be paid for no-shows, late arrivals or guest cancellations. In the event that the activity has not been prepaid, a full cancellation charge will be processed to the guest’s credit card.
4. Please ensure the correct passenger numbers, date and departure time is confirmed as you are liable for the full fee according to your confirmation. In the event of no shows/less passengers than what is stipulated on the booking confirmation you will be charged accordingly.
• Within 72 hours, no cancellation fee
• 48 hours or less – 50 % cancellation fee will be charged
• 24 hours or less – full fee payable will be charged
5. All cancellations must be received in writing and will only be valid on receipt of a written cancellation confirmation from The Featherbed Company.
6. Any changes must be at least 14 days in advance, especially when there are meal arrangements
7. In the event of unfavourable weather conditions Featherbed Co will only make the final judgement on the departure no later than one hour prior to the scheduled time. All guests will be notified telephonically should a tour or cruise be cancelled.
8. In the event of any tour or cruise is cancelled by the management of Featherbed Co, a full refund will be given on the amount paid (or refunded to the booking agent).
9. All requests for amendments to a reservation are required in writing by fax or email at least 7 days prior to the date of departure. Amendments may be approved subject to availability at the sole discretion of Featherbed Co. Management.
10. All refunds will only be processed on the same method of payment at the time of booking eg; credit card or via EFT.

INDEMNITY
 

The below disclaimer appears on all tickets and boarding passes. All guest agree to the indemnity clause upon receipt of any ticket/boarding passes and boarding our vessels.
By accepting this ticket and boarding the vessel, being conveyed thereupon and utilising the amenities/facilities therein I acknowledge and agree that I and those of my minor children and other dependants who accompany me (all of whom I warrant that I am lawfully authorised to represent for the purpose hereof) do so sat our own risk and of our own volition and in the knowledge of the inherent risks entailed in doing so. I (together with those of my minor children and dependants who accompany me) hereby indemnify and hold harmless and waive any claim that I, my dependants, executors, contractors and agents arising out of any damage to my/our property or any injury to our persons caused by the negligent acts and/or omissions on the part of John Benn (Pty) Ltd, its directors, employees, contractors or agents.

CHILD POLICY
 

1. All children are classified as a passenger therefore children over 12 will be charged the full adult rate.
2. Children 4 to 12 will be charged the child rate. Children 3 and under will be complimentary.
3. Please note that no children will be permitted to sit on parents’ laps. children no matter the age are classified as a seat and will not be permitted to sit on any laps.
4. No unaccompanied minors are allowed on any vessels or tours.
